Due care must be demonstrable
Distributors must act with due care and check marking, identity, operator details and accompanying documents.
- 01
Establish the role
Determine whether you are the distributor, and whether own-brand sale, relabelling, or modification moves manufacturer responsibility to you.
- 02
Check before making available
Marking, product and batch identity, manufacturer and importer details, and instructions in the right language.
- 03
Document the due care
Record checkpoint, result, date, product version, supplier and reviewer. A verbal assurance is not enough.
- 04
Preserve compliance
Storage, transport, and repackaging must not break marking, seals, or accompanying documents.
- 05
Act on suspected non-compliance
Stop further supply, secure affected batches, and inform the manufacturer, importer, and where needed the authority.
